SouthWest Sanctuary and The Chi Center, Inc. – Guest Participation Agreement, Liability Waiver & Media Release

 
PURPOSE & PARTICIPANT SCOPE
SouthWest Sanctuary (SWS) is a sacred land and venue owned and operated by The Chi Center, Inc and Mingtong Gu. the venue hosts both:
  • Events and retreats organized by independent third-party facilitators, and
  • Events and gatherings directly curated by SWS, Mingtong Gu, and The Chi Center — including offerings such as Magical Sundays and Wisdom Healing Qigong Retreats.
This agreement applies to all guests who participate in activities on the SWS/TCC property.
 
ACKNOWLEDGEMENT OF PERSONAL RESPONSIBILITY
By entering the grounds of SWS and participating in any event, I agree to:
  • Take full responsibility for my physical, emotional, mental, and energetic wellbeing.
  • Understand that all activities are voluntary, and I may opt out of any session or practice at any time.
  • Honor the peaceful, sacred nature of the land and contribute to a respectful and coherent field for all.
 
LIABILITY WAIVER & RISK RELEASE
I understand and acknowledge:
  • Activities I may choose to engage in — whether movement, meditation, emotional processing, breathwork, sound healing, or other modalities — involve inherent risks.
  • My participation in such practices is entirely voluntary and at my discretion.
  • For events facilitated by outside teachers or leaders, I understand these facilitators are independent contractors renting space from SWS and are solely responsible for the content and safety of their programming.
  • For events facilitated by SWS, Mingtong Gu and The Chi Center directly, I understand participation still remains voluntary, and I am responsible for assessing my own limits.
Therefore, I fully release and hold harmless Mingtong Gu, The Chi Center, Inc, and SouthWest Sanctuary, its owners, staff, affiliates, and volunteers from any and all claims, damages, injuries, or losses that may arise during or after my participation — whether caused by action, inaction, negligence, or otherwise.
 
PERSONAL PROPERTY & HEALTH
  • I accept full responsibility for my belongings while on the property. SWS nor The Chi Center, nor Mingtong Gu are not liable for lost, damaged, or stolen items.
  • I agree not to attend any event if I am experiencing symptoms of illness or have been recently exposed to contagious disease without medical clearance.
  • I understand that if I fall ill during my stay, I may be asked to leave to protect the health of others.
 
COVID-19 SAFETY ACKNOWLEDGEMENT
I understand that:
  • COVID-19 is an ongoing public health concern and carries risks of illness and transmission.
  • SWS cannot guarantee a COVID-free environment.
  • I am responsible for self-monitoring and following any current guidelines related to COVID-19, including distancing, testing, and masking as appropriate.
By attending, I voluntarily assume all risks related to exposure and agree to hold Mingtong Gu, SWS, and The Chi Center harmless for any illness contracted in connection with my visit.
 
MEDIA
I understand that from time to time, SWS, Mingtong Gu, or The Chi Center team may capture photographs or video of events to share the beauty, energy, and essence of its land and community.
 
LEGAL AGREEMENT & BINDING CONSENT
This agreement is binding on me, my heirs, legal representatives, and assigns. It is governed by the laws of New Mexico and intended to release all liability of Mingtong Gu, The Chi Center, and SWS to the fullest extent permitted by law.
I affirm that:
  • I am 18 years of age or older;
  • I have read and understood this agreement in full;
  • I am voluntarily signing this document and waiving certain legal rights, including the right to sue.
 
FOR MINORS (IF APPLICABLE)
If the participant is under 18 years of age, this section must be signed by a parent or legal guardian.
